In a [2]YouTube video now going "viral," a colleague of AAPS [3]member Rob
Steele, M.D., who is running against John Dingell for Congress, explains the
implications of Part 1 (the "stimulus bill") and Part 2 (PPACA) of ObamaCare
for rationing and the destruction of the patient-physician relationship.

Dr. David Janda apparently got the word straight from Congressmen that he
could be fined $100,000 for the first offense of defying the recommendations
from Washington bureaucrats in treating a patient—and jailed for the second
offense. Sending data to federal bureaucrats for immediate "advice" based on
Comparative Effectiveness Research is, he says, the meaning of "meaningful
use" of health information technology.

Will 46% of physicians, as stated by an Investors Business Daily poll, quit
practicing when ObamaCare goes into effect? Or will even more quit, once the
penalties described by Dr. Janda kick in?

Please speak up. The proposed national government health surveillance will be used to control your doctors. Your private medical, prescription, mental and behavioral data will be used without consent for rationing-based research to rationalize rationing.

The Stimulus bill mandates Electronic Medical Records and other Health IT systems by 2014. Doctors who fails to implement interoperable (online accessible) EMRs pay cuts from Medicare. The only way Drs. can say NO is to opt-out of Medicare (not a bad idea!)

The cost of compliance is huge. The Office of the National Coordinator of Health Information Technology (ONCHIT) predicts 50,000 new jobs to ensure health care providers implement electronic medical record systems, according to
POLITICO. Thirty-four (34) percent of "health care providers" (doctors? hospitals?) are using full EMRS and 16% have a partial system; 29% are evaluating the technology and 20 percent haven't considered it yet. (Politico, 10/26/10)

The title of the 3-page document to use for reporting in their preferred format is: Nationwide Health Information Network (NW-HIN) Governance Roles and Responsibilities.

HOWEVER, instead of filling out their form, consider sending an email with general comments
about the impact of the proposed government-imposed national health data system. Consider the following for inclusion:
  • There are no consent requirements. Your private medical and other data will be placed in the government's national health info network without your consent.
  • Under HIPAA, 2.2 million entities will have electronic access to your data without consent.
  • Individual rights under Fourth Amendment will be violated. Government search and seizure of papers, houses, affects, and persons will be enabled without consent or search warrant.
  • Personal and medical privacy will be broadly and widely infringed.
  • Government monitoring (and control) of you and your doctors will be enabled through the system.
  • Under ObamaCare doctors can be prosecuted for providing treatment that the government defines as "fraud, waste, and abuse." There are no definitions in law. "Data Analysis Techniques Increasingly Important in Detecting Health Care Fraud," (BNA Health IT Law & Industry Report, October 25, 2010 - subscription required)
  • All of your data can be  LINKED into one comprehensive record (no escape from their eyes).
  • Unconsented RESEARCH is enabled through electronic access to your data (as authorized by so-called HIPAA "privacy" rule).
  • Using access to treatment data, government agencies will attempt to control your doctor through use of financial, licensure, and other penalties if your doctor does not follow government-issued treatment protocols. (treatment protocols and payment restrictions coming from new ObamaCare entities)
  • Patient trust, and patient willingness to divulge information to doctors, will go the way of the dinosaur.
  • They are changing the name of the surveillance & tracking system (from Nationwide Health Information Network to what? Some euphemistic title that better hides the purpose??):

Wow, hard to imagine that the election is only a week away. Whatever the final outcome it is certain to be a very big gain for the Republicans, not only in Congress but in the states and local governments as well. All of the credit -- all of it -- goes to the great awakening and mobilization of ordinary Americans under the Tea Party banner. The Republican brand is still held in low esteem by most voters. The ONLY reason these voters are willing to vote Republican is in the hope that the party has been fundamentally changed by this awakening.


I remember in 1994, I was taking my daughter on a tour of college campuses in Virginia and North Carolina. We had just got done at Duke when the election results started coming in. The depth of the wave was evident as we listened to the local results on the car radio. Republicans were winning everything, from town council to county commissioners to state-wide races to congressional seats. This was in areas that hadn't elected a Republican since Reconstruction.


That year, too, was driven by a tidal wave of ordinary Americans who were afraid of what Democratic majorities were doing to the country, though at that time there was no national identity for the movement. Peter Jennings on ABC called it a temper tantrum by voters - unruly children who didn't understand what their betters were doing for them.


This year President Obama is already providing the narrative. He is attributing this wave to people who can't think straight because they are afraid. The parallels are striking.


The elite may not have learned anything in the intervening 16 years, but I hope the rest of us have. I was running CAHI at the time, and after the election our funding dried up. Our funders all said they had spent a lot of money on the election and now that the Republicans were in charge, they had nothing to worry about. They walked away just when they could have made a very big difference. [emphasis in this paragraph added by CCHC]


Folks, the election is only the beginning. The fact that the free market people walked away in 1995 is exactly what allowed the Congressional Republicans to go astray. It is not enough to elect good people. All that gets you is a hearing - a chance to make your case. This is especially true in health care.


I cannot emphasize this strongly enough - REPUBLICANS DON'T CARE ABOUT HEALTH CARE! They don't understand it and they aren't interested in it. What they are proposing today are just the warmed-over ideas of the last eight years (tort reform, association health plans, interstate purchase, etc.) They don't understand the pernicious role of third-party payment, or the importance of patient empowerment, or the distortions of the tax laws. Even the best of them, like Bobby Jindahl, are still tilting towards managed care. [CCHC adds:  Governor Pawlenty too (2010 MN Law (ObamaCare implementation) & 2008 MN health care reform law (Mn. Statutes 62U)]


If you want something positive done about health care, you can't stop at the elections. This is the time to plan for 2011 and budget for substantial contributions to the organizations that can make the case with the new Congress and the new governors.


The ball is now in your court. If you fail to deliver now you will have no one but yourself to blame for the outcome.

Unelected federal bureaucrats are forcing New York City to spend $27 million to replace their street signs. Our bureaucratic overlords maintain that streets signs must contain both upper and lower case letters, instead of just capital letters! Do you feel grateful that you're being protected from upper case streets signs?

This dictatorial mandate comes from the Federal Highway Administration, and applies to every community in America, not just New York City.

But don't blame this outrage on the busy-body Democrats. This isn't an Obama directive. The rule was actually promulgated back in 2003 -- during the Bush Administration.

Regardless of which party rules, very little is done to stop unfunded mandates or bureaucratic law-making. The problem is, Republicans have been promising to get rid of unfunded mandates since their so-called "Contract With America" way back in 1994!

The GOP controlled Congress and the White House for 6 years, but did exactly nothing to honor their promise.

This shows why we must remain committed to principles, not parties or politicians.

Now, here is what can be done about unfunded mandates, and you'll only read these next two ideas HERE, in the Downsizer-Dispatch.

First, New York City could tell the feds to, "Go to hell." City officials swore an oath to the Constitution too. They've read the highest law in the land. They know this is wrong.

That would be called, "nullification." To help promote this idea, Downsize DC President Jim Babka will be speaking at the Nullify Now! Conference in Orlando on October 10. There will also be two other opportunities to see (and meet) him this weekend. You can see the details here.

Second, if a single sitting GOP member of Congress was serious about fixing unfunded mandates imposed by un-elected bureaucrats, then he or she could sponsor's Write the Laws Act.

There are candidates who've pledged to do this, and you can read their names here.

But no incumbent member of Congress has yet stepped forward to introduce this powerful bill which would restore ALL legislative power to the House and Senate, and deny any legislative power to the Executive Branch, just as the Founders intended.

The Republicans tell us they believe in small government and the Constitution, but if that were really true they would introduce this bill.

Allowing bureaucrats to issue dictates that have the force of law amounts to legislation without representation. How un-Constitutional is that? How un-American? How hypocritical, especially for GOP members?

Please send a letter demanding that your representatives introduce and support the Write the Laws Act.

The FHWA is requiring street signs nationwide be replaced so that, for example, MAIN ST becomes Main St. Fonts must also be standardized. This underscores the need for the WTLA . . .

* This FHWA dictate is an unfunded mandate imposed by unelected bureaucrats on cash-strapped local governments, which means
* My state and local governments must pay for these changes by taxing me, even though we weren't represented in this ruling

I demand you do two things:

* Repeal the FHWA street sign requirement and return all powers of traffic control and safety to the states, exactly as the Tenth Amendment requires
* Introduce the Write the Laws Act so that Congress alone will write our laws and regulations, as the Constitution also requires

If you claim you want smaller, less-intrusive, common-sense government, then show me you really mean it by introducing DownsizeDC's Write the Laws Act.

It's finally here:   Our 10/10/10 Rally!  The forecast looks amazing.  Our program is set.   This will be a highly informative event covering all sorts of timely topics designed to educate, challenge and motivate us all to do our part in making an indelible mark on our nation's history. 

We're discouraging signs so that those who are bent on disparaging our movement and trying to marginalize our event will have little or nothing to distract from the main message in words and music from the stage.  So, bring a lawn chair, a friend, a neighbor and your patriotic fervor.   And let's commit ourselves in unity to the higher cause of restoring America to her unprecedented greatness. 
10/10/10 Rally, Sunday!
4pm - 6pm on Jefferson Square

The Louisville Tea Party invites you to come out and bring a friend or two with you for a Sunday afternoon of timely teaching on founding principles, celebration with patriotic music and being energized and mobilized to impact the election cycle as never before.  This will be a strictly grassroots citizens' event, featuring dynamic speakers from our region.  Also taking the podium will be Marilyn Parker ("Mom Without a Teleprompter"  and political activist), Wendy Caswell (Louisville Tea Party founder), Les Naiman (The Voice of Liberty in Louisville), Scott Reed, Dan Blanchard (Louisville Tea Party President) and , Larry Hausman.  We're excited to have added to our program,  Jim Waters, of The Bluegrass Institute, Randy Walters with Coal-Fed Families and Pajama Media columnist, Sarah Durand.  Our MC for the event will be the resonant voice of  Jim Coyle. 
The Rally's emphasis will be on education, so each speaker has a subject designed to inform and challenge us all.  To date, our topics will be:

    Patriotic and celebrational music will be provided by Louisville's own acappella vocal band, Water's Edge.   And the Over-Reactors will take the stage as well.  Please join us for this afternoon of education and inspiration.  And leave even better equipped to make a  informed Americans!

    Booth Space for Organizations & Campaigns are available.  Merchandise booths will not be made available at this event.   Why?  The cost of the event is not unsubstantial and so we encourage you to visit our own booth where there will be patriotic flags, buttons, bumper stickers, bracelets and T-shirts.  They make a distinctive statement and help us to fund events such as these.   Thank you!

    The supplier of Tea Party Patriots products online is going to run television ads in Kentucky tonight and tomorrow promoting Tea Party Patriots 1 Million Yard Sign Campaign.  If the ads go well, they will roll them out in more areas of the country.  If you are in KY be sure to watch for the ads tonight.     TPP Launches First Televised Ads
    Kentucky is the lucky state which will broadcast the first TPP ads on TV in support of our One Million Yards Signs by Election Day campaign.
    The ads are being produced and sponsored by the company that makes the yards signs and other branded Tea Party Patriots products. The 30-second spots will air in Kentucky's six media markets, with more markets set to be added in the near future.
    A link to the TV spot is available at and our Facebook and Ning sites. The ad encourages Americans who support the Tea Party core values to increase the visibility of the tea party message by placing signs in their yards.
